Fight over bathroom results in assault conviction for Westlock man

The accused was in the bathroom for an extended period of time, court heard.

WESTLOCK – A man who represented himself during a trial on an assault charge has been found guilty in Westlock Court of Justice on Dec. 4. 

Court heard that Albert Dean assaulted his nephew at a home in Westlock in April 2023. 

The confrontation started when his nephew wanted to use the bathroom but Dean was in the bathroom for an extended period of time, court heard. At some point Dean left the bathroom and his nephew used the facility. When he came out there was a verbal confrontation between the two that became physical. 

The nephew left the house and headed towards a neighbour’s house but Dean followed him outside, headbutted him, punched him in the face twice and kicked him, court heard. 

The mother of the victim had testified that when she arrived at the home she saw her son outside in his underwear and on the phone with the RCMP. 

In his defence, Dean alleged that the nephew had lunged at him outside but Justice Gordon Putnam said that was “implausible.” 

He said he couldn’t find Dean guilty in the first incident but found him guilty in the second incident where he followed his nephew outside. 

A pre-sentence report was ordered ahead of Dean's scheduled sentencing on Feb. 12.
