BARRHEAD - A Fort Assiniboine man received a conditional discharge with 12 months probation for a brick-throwing incident in the hamlet in the summer.
Justice Bruce Garriock handed down the sentence of Michael Wesley Talbot, accepting a joint submission from the Crown and defence after he pleaded guilty to mischief damage under $5,000 during a Dec. 10 Barrhead Court of Justice session.
Probation conditions include having no direct or indirect contact with the complainant, not coming within 20 metres of any known residence, place of employment or education, or worship of the complainant, and reporting as directed by his probation officer.
As part of his probation, the accused must also complete 10 hours of community service by Nov. 7, 2025.
Justice Garriock also waived the victim fine surcharge.
The matter had been scheduled to go to trial that day.
However, the accused opted to change his plea at the last minute.
The Facts
Crown prosecutor Francis Wallace said on July 31, 2024, in the early morning hours, Barrhead RCMP responded to the hamlet following a complaint by a resident stating that Talbot threw two bricks at her home, causing damage to its siding.
The Crown also acknowledged that the accused had a criminal record but called it very dated, saying it went back to 1987 and that it included multiple unrelated driving offences.
"The gravity of the offence isn't so significant that it would be contrary to the public interest to grant Mr. Talbot a conditional discharge given the circumstances," Wallace said.
